Cottage Food

Workable

Utah has two paths. Traditional Cottage Food Law (2007): $50,000/year cap, food handler permit required, home inspection required. Home Consumption/Homemade Food Act (Food Freedom, HB 181, 2018): no cap, no food safety course, no inspection, no permit. Both: non-TCS foods. Poultry allowed if slaughtering fewer than 1,000 birds/year.

Revenue Cap
No revenue cap

Traditional path: $50,000/year cap with permit + inspection. Food Freedom path (HB 181): no cap, no requirements.

Food Freedom Laws

Advantaged

Utah's Home Consumption and Homemade Food Act exempts a very broad range of homemade foods — including many time/temperature-controlled items — from state licensing and inspection, but only for in-person, direct sales to the final end consumer for home consumption (no third-party resale or shipping). No revenue cap.

Domestic Kitchen

Workable

Utah's Microenterprise Home Kitchen Act (HB 94, 2021) is a permitted home-kitchen tier above its cottage/home-consumption exemptions: with a permit and inspection it allows preparation and sale of cooked, potentially-hazardous, and meat-containing foods (same-day), administered under the Utah Health Code by the Department of Health & Human Services and local health departments. Online sales are allowed; municipalities may cap the number of permits rather than imposing a dollar cap. (Utah also has a separate food-freedom statute — see the Food Freedom vertical.)
